Amendments

What are Amendments?

Amendments are changes to the local planning scheme made in accordance with the Planning and Environment Act 1987.  An amendment can be initiated by the Minister for Planning, or by Council as the planning authority.  A planning scheme may need to be amended to:

  • implement new state, regional or local strategies and policies;
  • generally update the scheme;
  • allow a use or development prohibited under the current zoning in the scheme; or
  • reserve land for acquisition as a public purpose or to remove such a reservation when it is no longer required.

When an amendment is proposed, affected people are notified, a consultation process takes place and the merits of the amendment are assessed by Council.  Council decides whether to proceed, abandon or refer the amendment to an independent Panel for consideration and a recommendation.  If concerns about an amendment cannot be resolved, the submissions may be referred to an independent panel for consideration.  The Panel report is considered by Council prior to Council making a recommendation to the Minister for Planning regarding the amendment.  An amendment has no statutory effect until approved and gazetted by the Minister for Planning.  Gazetted amendments may be viewed within the Department of Sustainability and Environment web site under Planning Scheme Amendments ONLINE.
