Legal requirements when building
The following legal requirements must be considered when completing development:
Animals
All animals taken onto a site:
- must be securely confined to the site, and when off that site controlled via a cord, chain or leash;
- must not chase, attack or cause a nuisance to any person or animal
- must be registered with a Council and wearing its tag whilst in a public place
Litter
All gutters, drains, pits, footways, nature strips and streets must be kept safe, clean and tidy at all times. Gutters, drains and pits must not be used for washing down equipment or for the purposes of brick cutting or concrete mixing. Additionally all litter must be securely contained within the building site.
Local Laws Permits
- Fires: No person may light or allow to remain alight any fire in the open.
- Toilet facilities: Toilet facilities must be provided on all working sites and they can either be existing facilities connected to normal sewage lines with working flush or an approved temporary chemical toilet facility contained on site.
- Waste bins (Skips): Bins can only be placed on the road or a nature strip subsequent to a permit being issued by Council’s Local Laws Department. All waste bins (skips) on or partially on roads, must have a light illuminated on them clearly visible to approaching traffic between sunset & sunrise. No permit is required for a bin placed within the boundary of the property.
- Building material/equipment: No building material or equipment is to be placed on the footway, nature strip or road without first obtaining a permit from Council’s Asset Protection Department.
- Drain tapping: A permit is required from Council’s Engineering Services Department to connect into Council’s stormwater drainage system prior to such work being undertaken. Upon completion of works an inspection by Council staff is required prior to back filling.
- Tree protection: A permit is required to be obtained from Council’s Local Laws Department before trimming, pruning or removing any tree which is contained on the Council’s Significant Tree Register or alternatively any tree with a trunk circumference greater than 155 centimetres measured 1 metre above ground level. Additionally, developers should check their planning permit regarding the possible retention of specific trees. No mechanical excavation may take place within the drip line of a Council tree. The drip line is defined as the outer most end of the branches or in the case of a tall narrow tree the distance from the trunk one third of the tree’s height. No Council trees may be pruned or removed without permission from Council’s Local Laws Department.
- Road opening permit: For any works which require excavation within the road reserve i.e. water tapping, drain tapping/connection, vehicle crossovers etc, builders are required to obtain a temporary crossover permit from Council’s Engineering Services.
- Vehicle crossings: A permit is required to construct or repair any vehicle crossing within the municipality of Bayside. Upon application to Council’s Engineering Services, a Council Officer will inspect the crossing to ensure the protection of Council’s and other Authorities’ assets. Council’s Asset Permit: To enable Council to protect assets, such as footways, drains etc, from damage during building works, builders must obtain a temporary crossover permit from Council’s Engineering Services prior to commencement, otherwise you will be responsible for all damage identified at the completion of the project. Occupation of the Road: A permit is required to be issued by Council’s Asset Protection Department where it is proposed to occupy a road for any reason such as:
- occupying or fencing off part of the road
- erecting a hoarding or overhead protective awning
- using a mobile crane or travel tower for any building works.
Noise
Under Section 48A (5) of the Environmental Protection Act any building noise which is audible in a habitable room of a neighbour’s house outside the prescribed hours is an offence.
The prescribed hours are:
- Monday to Friday: 7am-8pm
- Weekends and public holidays: 9am-8pm
Vehicle parking
All parking restrictions will be enforced, including:
- time restrictions (if applicable)
- no parking on nature strips or footways
- no parking within ten metres of an intersection
- no double parking.
