Compliance

The following legal requirements must be considered when completing development:

Local Laws Permits

  • Building material/equipment: No building material or equipment is to be placed on the footway, nature strip or road without first obtaining a permit from Council’s Asset Management Department.
  • Drain tapping: A permit is required from Council’s Asset Management Department to connect into Council’s stormwater drainage system prior to such work being undertaken. Upon completion of works an inspection by Council staff is required prior to back filling.
  • Fires: No person may light or allow to remain alight any fire in the open.
  • Road opening permit: For any works which require excavation within the road reserve i.e. water tapping, drain tapping/connection, vehicle crossovers etc, builders are required to obtain a temporary crossover permit from Council’s Asset Management Department.
  • Toilet facilities: Toilet facilities must be provided on all working sites and they can either be existing facilities connected to normal sewage lines with working flush or an approved temporary chemical toilet facility contained on site.
  • Tree protection: A permit is required to be obtained from Council’s Amenity Protection Department before trimming, pruning or removing any tree which is contained on the Council’s Significant Tree Register or alternatively any tree with a trunk circumference greater than 155 centimetres measured 1 metre above ground level. Additionally, developers should check their planning permit regarding the possible retention of specific trees. No mechanical excavation may take place within the drip line of a Council tree. The drip line is defined as the outer most end of the branches or in the case of a tall narrow tree the distance from the trunk one third of the tree’s height. No Council trees may be pruned or removed without permission from Council’s Amenity Protection Department.
  • Vehicle crossings: A permit is required to construct or repair any vehicle crossing within the municipality of Bayside. Upon application to Council’s Engineering Services, a Council Officer will inspect the crossing to ensure the protection of Council’s and other Authorities’ assets. Once satisfied with the location, a Vehicle Crossing Permit will be issued at a fee.

  • Asset protection
    An Asset Protection Permit is issued to ensure that any damage to Council’s assets as a result of building associated works, including demolition, is repaired at the cost of those responsible.  These assets include footpaths, nature strips, kerb and channel, trees, signs, stormwater drains and road pavement. Owners, builders, developers etc are required to take out an Asset Protection Permit for a non refundable fee.  It is necessary for the permit holder to lodge a security deposit that will be refunded upon satisfactory completion of works or expended by Council for the reinstatement of any damage caused by building works.  In determining the value of the deposit required, Council will take into consideration the extent of the works and the potential for damage. The Asset Protection Permit must be taken out prior to the commencement of any building activity.  The Asset Management Department is responsible for the issuance of this permit.
  • Hoarding/Crane Permit
    In the event of builders/developers etc occupying Council land, eg road, footpath or nature strip to use for storing building materials, or erection scaffold or fencing, etc, a Hoarding Permit is to be taken out.  In the event of road closure this application has to be completed along with a traffic management plan.  This application form is also applicable for use of a crane, cherry picker or scissor lift.  The Asset Management Department is responsible for the issuance of this permit.
  • Waste bins (skips)
    Skip Bins can only be placed on council land subject to a permit being issued by council. Find out more about skip bin permits.

Noise

Under Section 48A (5) of the Environmental Protection Act any building noise which is audible in a habitable room of a neighbour’s house outside the prescribed hours is an offence.

The prescribed hours are:

  • Monday to Friday: 7am-8pm
  • Weekends and public holidays: 9am-8pm

Vehicle parking

All parking restrictions will be enforced, including:

  • time restrictions (if applicable)
  • no parking on nature strips or footways
  • no parking within ten metres of an intersection
  • no double parking.

Animals

All animals taken onto a site:

  • must be securely confined to the site, and when off that site controlled via a cord, chain or leash;
  • must not chase, attack or cause a nuisance to any person or animal
  • must be registered with a Council and wearing its tag whilst in a public place

Litter

All gutters, drains, pits, footways, nature strips and streets must be kept safe, clean and tidy at all times.

Gutters, drains and pits must not be used for washing down equipment or for the purposes of brick cutting or concrete mixing.

Additionally all litter must be securely contained within the building site.
