Federal legislation

Federal Government legislation sets precedents for State and Local Governments to follow.

The following Acts influence the way Bayside Cituy Council approaches Open Space Management:

  • Environment Protection & Biodiversity Conservation Act: This Act targets conservation and environmental protection. It also specifically addresses the roles and responsibilities for Local Government in implementing the Act.
  • Native Title Act: This Act recognises land custodianship/ownership. It provides a way for land use, which would otherwise be under to Crown Land law, to be open to change so that our cultural heritage is recognised.
  • Protection of Moveable Cultural Heritage: Australia's cultural heritage is protected under this Act. Powers extend from inland waters to land and from seabeds to soil, serveing to protect objects ranging from military use to indigenous artefacts.
  • Environment Protection (Sea Dumping) Act: The importance of this Act is that sea pollution is made a criminal offence. Here you will find lists of controls and actions that are implemented for sea protection in Australia.
  • Sea Installations Act: For planning, management and development purposes, the Sea Installations Act controls the type of development that can occur in Australia's seas and along Australia's coast.
  • Historic Shipwrecks Act: The Act defines management responsibilities and regulates activities for the preservation of historic shipwrecks (for example the Cerberus located in Bayside)
