Vegetation overlay

Vegetation overlay map A Vegetation Protection Overlay exists under Bayside City Council's Planning Scheme for the areas of Black Rock, Beaumaris, Cheltenham (south of Park Road) and Sandringham (south of Edward Street).

The Vegetation Protection Overlay protects vegetation native to Australia that is over a certain size criteria, from being removed, destroyed or lopped without a planning permit.

The vegetation protection objectives of the overlay are:

  • To prevent the loss of native and particularly indigenous vegetation destroyed by development.
  • To retain the amenity, aesthetic character and habitat value of Australian native vegetation and indigenous vegetation in particular within the areas of Black Rock, Beaumaris, Cheltenham (south of Park Road) and Sandringham (south of Edward Street). 
  • To promote the regeneration and replanting of indigenous species in the Beaumaris and Black Rock area.

Permit requirements

A permit is required to remove, destroy or lop* any vegetation native to Australia.

This does not apply to:

  • The removal, destruction or lopping of vegetation which is less than 2 metres high or has a single trunk circumference of less than 0.5 metres at a height of one metre above ground level.
  • The pruning** of vegetation to remove that part of any branch which overhangs an existing dwelling or is within two metres of an existing dwelling

* Bayside City Council does not consider lopping of vegetation as an acceptable pruning practice and is not an acceptable pruning practice under the Australian Standard AS4373 - Pruning of Amenity Trees.
**All pruning works must be carried out in accordance with the Australian Standard AS4373 - Pruning of Amenity Trees.

The VPO3 Planning Permit Application form must be submitted to Council before a permit may be issued.
