Public Exhibition of Amendment C90 - The Black Rock Neighbourhood Activity Centre Structure Plan
Bayside City Council is proposing, through Amendment C90, to introduce policies and controls into the Bayside Planning Scheme to implement the Black Rock Neighbourhood Activity Centre Structure Plan (2009). These policies and controls will guide the future development of the Black Rock Activity Centre.
The Black Rock Neighbourhood Activity Centre Structure Plan seeks the following planning outcomes:
- To reinforce the centre’s local convenience role by encouraging uses that will provide active retail or commercial shop fronts at ground floor level with office or high density residential above.
- To encourage sensitively designed built forms up to a height of three storeys that respect the centre’s local character, maintains views to Port Phillip Bay and does not unreasonably impact adjoining residential areas whilst providing for urban growth.
- To prioritise pedestrian safety and movement throughout the centre whilst ensuring an adequate supply of off street car parking is maintained.
In order to achieve this, the amendment proposes to;
- rezone land from Business 2 to Business 1 Zone and Mixed Use Zone;
- rezone land from Residential 1 to Mixed Use Zone;.
- rezone land from Residential 1 to Business 1 to correct a zoning anomaly);
- amend Clause 21.06 of the Bayside Planning Scheme to include reference to the Black Rock Village Neighbourhood Activity Centre Structure Plan (2009);
- introduce a local policy specific to the Black Rock Village Activity Centre which gives effect to the Structure Plan and details broad objectives for the Centre;
- remove DD01 from the Black Rock Village Neighbourhood Activity Centre and replace it with Schedule 8 (DDO8), which specifically applies to the centre and provides objectives and standards in relation to built form, interfaces and the public realm. Specifically, the Overlay;
- limits the height of new development within the Centre to a maximum of three storeys;
- requires active frontages at ground floor level within the Centre;
- requires that new development does not impinge upon solar access within the Centre to residential properties within the centre; and
seeks to protect views towards the foreshore and enhance the Centre’s relationship with the foreshore.
The amendment affects all land within the Black Rock Neighbourhood Activity Centre, as outlined in the map below:

Written submissions on the amendment are invited from Thursday 17 March 2011 and will be received by Council up until 5.00pm on Wednesday 31 August 2011. Submissions should include “Amendment C90” in their title and sent to:

How to write a submission
When writing a submission, please consider the following points.
A submission should;
- clearly identify the amendment it refers to, by citing the amendment number(ie: Am C90);
- set out the submitter’s views on the amendment (for example why the submitter supports or opposes the amendment and how the amendment will materially affect the submitter);
- where appropriate, the submission should respond to the specific strategic planning basis for the amendment, or clearly set out the relevant planning considerations upon which the submitter’s view is based;
- set out what the submitter would like the planning authority to do (for example abandon the proposal completely, exclude certain land from its effect, include additional conditions on a proposed use or approve the amendment as exhibited);
- give the submitter’s name and address, email and phone number for contact during office hours. In the case of a submission made jointly by a number of people, the submission should nominate one person as the group’s representative to receive notices and for representation at a panel hearing.

What Happens Next?
Once submissions close on Wednesday 31 August 2011, Council will consider all submissions received and submitters or interested parties may request to speak at the relevant Council meeting.
If Council does not agree with some or all of the submissions, it will refer them and the amendment to an independent Planning Panel (appointed by the Minister for Planning) for consideration. The panel will consider all submission referred to it. In addition, submitters can request to speak to their submission at the panel hearing. The panel will then make recommendations to the Council on the amendment. It is therefore important that contact details are provided so that Council can keep you informed as the process progresses.
Council will make a decision on what to do with the amendment taking into account the panel recommendations.
