Amendment C174bays – Heritage Controls at 38 Grosvenor Street, Brighton

This amendment has been prepared by the Bayside City Council who is the planning authority for this amendment. 

What will the amendment do?

The Amendment seeks to apply the Heritage Overlay to 38 Grosvenor Street, Brighton on a permanent basis. The current Heritage Overlay on the property has been applied on an interim basis, with those controls set to expire on 30 October 2020.

Amendment C174bays implements the recommendations of the heritage assessment undertaken on behalf of Council, which found the house to be of historical and aesthetic significance for the reasons outlined in the citation. 

Where are we up to?

The exhibition period for Amendment C174bays closed on 1 March 2020. Council considered all submissions received at its Ordinary Council Meeting on 24 March 2020.
At its meeting, Council resolved to request the Minister for Planning to appoint an independent Planning Panel to consider the submissions received.

The Panel Hearing for Amendment C174bays took place on the 27 & 28th July 2020 by video conference. Council received the Panel Report from Planning Panels Victoria on 14 August 2020. You can read the Panel Report by clicking the following link.

Council considered the recommendations of the Panel at its Ordinary Meeting of Council on 15 September 2020. At its Meeting, it was resolved that Council:

  1. Adopts Amendment C174bays incorporating the Panel’s recommended changes;
  2. Submits Amendment C174bays to the Minister for Planning for approval in accordance with Section 31 of the Planning and Environment Act 1987; and
  3. Writes to all submitters to advise them of Council’s decision.

What happens now?

The last step in the planning scheme amendment process is for the Minister for Planning to make a decision about whether to approve Amendment C174bays.

All submitters and interested parties will be advised of the Ministers decision.
