1. In order to ensure fairness to all applicants:
- Only two street stalls per year are permitted per organisation.
- Bookings will be taken no more than three months in advance
2. Application for approval be made in writing 21 days prior to the required date addressed to Amenity Protection Administration, P.O. Box 27 Sandringham 3191. Telephone enquiries to an Amenity Protection Administration Officer, on 9599 4444
3. The applicant is to indemnify Council and take responsibility for any damage to person/s and/or property as a result of this use, and provide evidence that Public Liability insurance cover for a minimum of $10 million is shown to exist showing the Bayside City Council as an interested party.
4. While conducting a street stall all staff must carry a copy of Council’s permit with them at all times.
5. All or any staff must comply with any direction given by an authorised Officer of Council or a member of the Victoria Police.
6. All articles such as tables and chairs are placed kerbside, in accordance with the Bayside City Council Footpath Trading Policy (refer diagram over page).
7. The organisers must remove any litter and refuse.
In addition, for Street Stalls with foodstuffs:
8. If any foodstuffs are being offered for sale must be registered on Streatrader A Statement of Trade must be completed and submitted for assessment by Council’s Environmental Health department.
9. No sausage sizzles or similar food stalls on Council land may be conducted unless the trader in front of whose shop the sausage sizzles or similar food stalls on Council Land is proposed has given his/her written consent to the installation of the stall in that position and this consent must be lodged with the application.
10. No sausage sizzles or similar food stalls on Council land may be conducted within 9m of an intersection, pedestrian crossing or tram or bus stop or within 18m of a school crossing or where the location of a sausage sizzle or similar food stalls on Council land may cause undue obstruction to pedestrians.
11. The location of sausage sizzles or similar food stalls on Council land shall be at the discretion of the Coordinator Local Laws & Investigations.
12. Any request for a permit to conduct sausage sizzles or similar food stalls on Council land activities will be considered in line with Footpath Trading Policy standard footpath trading areas conditions (refer over page).
13. A plan of the structure and proposed positioning of any cooking device, barriers and other equipment, must accompany the application.
14. Where permission is granted for the conduct of a sausage sizzles or similar food stalls on Council land, the use of no more than 1 small table and 2 chairs shall be permitted provided that no undue obstruction is caused to pedestrian traffic.
15. All cooking devices must be located in the trading Zone and must be placed at a 90 degree angle to the kerb. This will ensure any queue that forms will leave pedestrian access clear along the footpath.
16. The maximum permissible area of footway to be used for the conduct of a sausage sizzle or similar food stalls on Council land is 3.3sqm, provided the footpath is not obstructed and a clear walking space of 1.8m (measured from the building line) is maintained at all times.
17. Customers must not be served on the side of any cooking device facing the pedestrian zone.
18. All cooking device facilities must be fully partitioned with suitable barriers to prevent injury to the public.
19. All cooking devices must be fitted with a device that captures all cooking waste and be managed to not litter or impact on the pavement or surrounding area.
Footpath trading in Bayside
Bayside City Council’s Footpath Trading Policy requires that footpaths are unobstructed and that pedestrians have safe access to them at all times. This policy requires that all articles be placed kerbside.
All goods, A-frames and tables and chairs must be placed kerbside within the trading zone to bring all premises in line with Council’s Footpath Trading Policy (see diagram).
Standard footpath trading areas
Where footpath width is between 2.5m –3.5m
Pedestrian zone: extends from building line for a minimum of 1500mm
Kerbside zone: 400mm buffer from kerb
Where footpath width is between 3.5m – 4m
Pedestrian zone: extends from building line for a minimum of 1800mm
Kerbside zone: 500mm buffer from kerb
Where footpath width is 4m or wider
Pedestrian zone: extends from building line for a minimum of 2000mm
Kerbside zone: 600mm buffer from kerb
