Notice of Intention to Lease North Point Café (2b North Road, Brighton)

Bayside City Council (Council) gives notice in accordance with Sections 190 and 223 of the Local Government Act 1989 (Act) of its intention to enter into a lease with Same Pty Ltd for the tenancy of the building known as North Point Café (at 2b North Road, Brighton).

The proposed lease is for a total of 21 years, at a commencement base rental of more than $50,000 (plus GST), yet to be determined by Council’s Property Valuer and subject to annual increases in line with Consumer Price Index Melbourne All Groups (CPI). The permitted use of the premises is for a café / restaurant. Additional turnover rent would be calculated at 7.5% of gross turnover that exceeds 12.5 times the base rent.

Any person lodging a submission on the proposed lease must do so before 5:00pm Friday 21 June 2019.

If a person wishes to be heard in support of their submission, they must clearly indicate so in their submission. This will entitle them to appear in person, or by a person acting on their behalf, before a Special Committee of Council to be held on Wednesday 10 July 2019 at 6:30pm in the Council Chambers, Boxshall Street, Brighton. The meeting will proceed if one or more persons request to be heard in support of their submission.

All submissions will be considered in accordance with section 223 of the Act. The submissions (including any personal information) are not confidential and will be included in the public report to Council and may also be made available on Council’s website.
