Proposed Discontinuance & Sale of Part of Road at Rear of 70 Esplanade, Brighton

Bayside City Council (Council) gives notice under Section 189, 206 and Clause 3, Schedule 10 of the Local Government Act 1989 (Act), that it proposes to discontinue and sell part of the road at the rear of 70 Esplanade, Brighton, which is shown hatched on the plan below, being part of the land in certificate of title volume 10437 folio 824 for $275,000 including GST.

Any person wishing to make a submission on the proposed discontinuance and sale must lodge their submission before 5:00pm Thursday 21 March 2019.

Submissions may also be delivered to the Corporate Centre, 76 Royal Avenue Sandringham.

If a person wishes to be heard in support of his or her submission, they must include the request to be heard in the written submission and this will entitle them to appear in person, or by a person acting on their behalf, before a Special Committee of Council to be held on Tuesday 26 March 2019 at 6:30pm in the Council Chambers, Boxshall Street, Brighton. The meeting will proceed if one or more persons request to be heard in support of their submission.

All submissions will be considered in accordance with section 223 of the Act.

Submissions made in accordance with section 223 of the Act are not confidential and will be incorporated in full (including any personal information) into the agenda and minutes of any Council or Committee meeting at which the matter is considered. The submissions will be available on Council’s website as part of any relevant Council or Committee agenda and minutes.

Following consideration of submissions, Council may resolve to discontinue and sell part of the road or do nothing.
