Planning permit exemptions for bushland reserves - Amendment C112

Amendment C112 was approved by the Minister for Planning on February 12 2015. Amendment C112 amends the Bayside Planning Scheme to remove the requirement for Council to obtain a planning permit to remove, destroy or lop native vegetation within its seven inland bushland reserves. These changes are intended to improve Council’s management of bushland reserves. 

The seven bushland reserves to which this exemption will apply are:

  • Balcombe Road Heathland Sanctuary
  • Bay Road Heathland Sanctuary
  • Cheltenham Park Reserve
  • Donald MacDonald Reserve
  • George Street Reserve
  • Gramatan Avenue Heathland Sanctuary
  • Long Hollow Heathland

Ecological burning and the removal of native weed species are established practices in natural resource management that are vital to promote the health of heathland vegetation in Bayside’s bushland reserves. Currently, Council requires a planning permit to carry out both practices. This results in a considerable administrative, cost and resource burden. 

Affected residents will continue to be notified of future ecological burns in accordance with Council’s Ecological Burn Resident Notification Procedure. Preparation is underway to conduct an ecological burn at Long Hollow Heathland on 24 March 2015. 

The Amendment was placed on exhibition from 26 September 2013 to 28 October 2013. Council received one hundred and fifty six (156) submissions during the exhibition period. Council requested that the Minister for Planning consider holding a joint planning panel for Amendment C112 and Amendment C110 as both these Amendments shared similar issues and parties.

Amendment C110 proposes to implement the Bayside Open Space Strategy and the Bayside Open Space Strategy: Suburb Analysis and Action Plan.

A joint Panel Hearing was held on 17 and 27 February 2014. Council received the Planning Panel Report on 24 March 2014 and resolved to adopt this amendment at its Ordinary Meeting on 29 April 2014.
